====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Rajgir P.S. Case No. 210 of 2018, instituted for the offence under Section(s) 406, 380, 307, 323 and 504/34 of the Indian Penal Code. Counsel for the petitioner submits that petitioner and informant are Gotiyas.

It is mentioned in the order of learned 3rd Additional District & Sessions Judge that tractor and piling machine were found lying at the door of the informant. The informant alleged that he had given his tractor and piling machine to the petitioner on consideration amount of Rs.9,50,000/- and petitioner had agreed to pay Rs.34,000/- per month to the informant in 28 installments.

Thereafter, he was not using the tractor and piling machine of the informant. The informant just to put pressure upon him, has filed the instant case.

Petitioner is in custody since 10.01.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Rajgir P.S. Case No. 210 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
