JUSTICE BIRENDRA KUMAR ORAL ORDER 15-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149/ 341 /323 / 447 / 338/307/302/504/506 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3/4 of the Explosive Substances Act. For land dispute allegation against co-accused Marhar Raut is that he threw bomb causing injury and death of the father of the informant. Though the petitioner was member of the unlawful assembly, however, no overt-act has been alleged against the petitioner.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.16305 of 2017 (3) dt.15-05-2017 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/Successor Court, in connection with Banka P.S. Case No.972 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
