JUSTICE SANJAY PRIYA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kharagpur P.S. Case No. 152 of 2015 instituted for the offence under Section 364(A) and 120(B)/34 of the Indian Penal Code.

There is allegation against this petitioner that he alongwith others as mentioned in the written report kidnapped the son of the informant Vivek Kumar. The another son of the informant Ranjan Kumar anyhow came back to his house at 9 A.M. in the morning and told about the occurrence. The statement of victim has been recorded under section 164 Cr.P.C. wherein he has taken name of this petitioner in his kidnapping and making demand of ransom.

The petitioner has criminal antecedent. There are

Patna High Court Cr.Misc. No.5650 of 2017 (3) dt.16-03-2017 2/2 several cases of serious nature under section 395, 392, 363 of the Indian Penal Code and section 25(1-b)/26 of the Arms Act pending against him.

Under such circumstances, this court does not find it a fit case for grant of regular bail. Accordingly, the prayer for bail of the petitioner is rejected at his stage. The petitioner may renew prayer for bail after six months, if no substantive progress is made in the trial.
