Supplementary Affidavit filed on behalf of the petitioner be kept on record.
Petitioner seeks bail in Nawada Town P.S. Case No.15 of 2018 instituted for the offence under Section(s) 302, 201, 120-B Indian Penal Code.
It is alleged that on the date of occurrence this petitioner along with four other named accused forcibly took his brother-in-law, Krishna Yadav, on Bolero vehicle. It has also been alleged that prior to aforesaid occurrence the petitioner and other accused persons have committed murder of his father-inlaw on 21.12.2013.
Patna High Court CR. MISC. No.15690 of 2019(3) dt.29-05-2019 2/2 Counsel for the petitioner submits that four other accused persons, who are named in the First Information Report, have already been granted bail by co-ordinate Bench vide Annexure-2 and 3. There is no direct evidence against the petitioner of committing overt act. During investigation, police recorded statement of driver and co-driver of the bus, who have not supported the case.
Petitioner is in custody since 08.05.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No.15 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
