The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 149, 323, 341, 337, 338, 332, 353, 504, 427 of the Indian Penal Code. As per allegation in the FIR, petitioner along with other co-accused persons create hindrance in discharging the official duty of informant. It is further alleged that all the accused persons started pelting stones on them, due to which several police personnel sustained injuries.

It is further submitted that there is admitted land dispute between one Mina Devi and the petitioner and due to this petitioner has been falsely implicated in the present case due to high handedness of police. From perusal of the impugned order, it appears that the injury sustained by the police personnel is simple in nature. Moreover, the petitioner is languishing in judicial custody since 22.07.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Similarly situated several co-accused persons have been granted bail vide order dated 53116 of 2022, passed on 17.01.2023 by the co-ordinate Bench of this Court. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody,

The above named petitioner is directed to be enlarged on bail in connection with Mansoorchak P.S. Case No. 57 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
