Petitioner seeks bail in a case registered for the offences punishable under Sections 323, 506, 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Learned counsel for the informant is appearing. Petitioner is the husband and allegation is under Section 498A of the Indian Penal Code.
The parties are ready for negotiation for restitution of conjugal right. The petitioner has already filed Matrimonial Case No. 210 of 2016 for restitution of conjugal right.
In the circumstances, let the petitioner, above named, be enlarged on provisional bail on furnishing bail
Patna High Court Cr.Misc. No.8658 of 2017 (2) dt.01-03-2017 2/2 bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City/successor Court in connection with Malsalami Police Station Case No. 289 of 2016. The court below shall call upon both the parties for amicable settlement of their dispute. If the petitioner would not be found co-operative his bail bond shall be cancelled and if he would be co-operative in the conciliation the bail bond shall be confirmed by the court below.
