The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 07.08.2021, his minor daughter went for tuition, but did not return home. It is next alleged that petitioner came to know that Raja Abhishek Singh, Arbind Singh and petitioner together have kidnapped his minor daughter from Md. Tetaruddin field. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that victim is 21 years of age and she has not supported the
Patna High Court CR. MISC. No.11735 of 2022(2) dt.12-09-2022 2/2 prosecution case in her statement recorded under Section 164 of the Cr.P.C., nor has disclosed the name of the petitioner. It is also submitted that a compromise petition has been filed in the learned trial Court as it has been specifically pleaded at Para-10 of the anticipatory bail application (Annexure-3).
Learned A.P.P. opposes the bail application.
Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Kahalgaon P. S. Case No.502 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
