JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Punpun P.S. Case No. 328 of 2016, registered under Section 399/402 of the Indian Penal Code and Section 25(1-b)a, 26/35 of the Arms Act.

The accusation is that on receiving secret information about gathering of the miscreants at Maauna turning for making preparation to commit heinous crime. The Police reached there and on seeing the Police two persons started fleeing, but on chase, they were apprehended, who disclosed their names as Chandan Kumar and Rahul Kumar. On search, petitioner was found in possession of one country made pistol and three live cartridges, whereas two live cartridges were

Patna High Court Cr.Misc. No.18628 of 2017 (2) dt.05-05-2017 2/2 recovered from the possession of co-accused Rahul Kumar. Learned counsel for the petitioner submits that petitioner has no criminal antecedent is in custody since 05.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Masurhi in connection with Punpun P.S. Case No. 328 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
