2. The petitioners seek bail in connection with Sadar Excise P.S. Case No.09 of 2024 instituted for the offences punishable under Sections 30(a), 32(3) of Bihar Prohibition and Excise Act.

3. The prosecution case, in short, is that there is recovery of 126 liters of liquor from the Xylo car bearing registration no.BR01PB7170.

4. Learned counsel for the petitioners submit that petitioners have falsely been implicated in the present case merely on the basis of suspicion. Learned counsel for the petitioners next submit that petitioners have no knowledge about the transportation of illicit liquor which is seized from Xylo car,

The learned counsel for the petitioners further submits that petitioners are neither the owner nor the driver of the car rather they are the passengers of the Xylo car. Learned counsel next submit that they are in custody since 19.01.2024 and has no concern with the illicit liquor.

5. Learned APP for the State opposes the prayer for bail of the petitioners.

6. Considering the entire facts and circumstance of the case and taking into account the period of custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Sadar Excise P.S. Case No.09 of 2024.
