ANJANA MISHRA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is specific allegation against the petitioner that he had attacked the deceased leading to his death. The post-mortem report conducted on the body of the deceased revealed no external injury. He further submits that co-accused Rama Shankar Singh who was taken into custody, has since been extended the privilege of regular bail by this Court vide order dated 10.09.2015 passed in Cr. Misc. No. 40666 of 2015.

Considering the aforementioned facts and circumstances

Patna High Court Cr.Misc. No.5525 of 2016 (3) dt.18-04-2016 P2/2 and that co-accused has been extended the privilege of regular bail and that the petitioner has been similarly placed and also because the petitioner has no criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 82/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
