2. The present writ petition has been filed for the following relief(s) :

"I. To direct the Circle Officer, Biraul, Darbhanga (Respondent No. 3) not to disturb the physical possession of the petitioner over his raiyati land and, II. To direct the Respondent State not to proceed with the construction works over the raiyati land of the petitioner which is pending adjudication before the Court of learned Sub-Judge I, Biraul, Darbhanga in T.S. No. 206/2022. The State of Bihar and others and III. To direct the learned Sub-Judge 1, Biraul, Darbhanga to adjudicate the injunction petition dt

Patna High Court CWJC No.2930 of 2025(3) dt.13-11-2025 2/3 08.06.2023 filed by the petitioner within a justified time and IV. To grant such other and further relief (s) as to which this Honourable Court may deem fit and proper in the facts and circumstances of the case and in the interest of justice."

3. Without going into the merits or demerits of this case, the present Writ Petition is disposed of at the stage of admission with the consent of both the counsels.

4. Having regard to the fact that the petitioner has already approached the Civil Court by way of Title Suit No. 206 of 2022 before the Sub-Judge I, Biraul, Darbhanga, this Court is not inclined to grant the prayer sought for in the present Writ Petition. However, as it is stated by the learned counsel appearing on behalf of the petitioner that pending the Title Suit the Respondent-Authorities are trying to change the nature of the land, though the petitioner has already filed an interlocutory application 08.06.2023 seeking interim injunction order and the same has not yet been disposed of.

5. Having regard to the same, this Court deems it expedient to direct the Sub-Judge I, Biraul, Darbhanga, to dispose of the injunction application filed by the petitioner in Title Suit No. 206 of 2022 as expeditiously as possible. Learned

Patna High Court CWJC No.2930 of 2025(3) dt.13-11-2025 3/3 Sub-Judge I before passing any order shall put all the parties on notice and give an opportunity of hearing.

6. With the above direction, this Writ Petition stands disposed of.
