JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2023 At the outset, learned counsel for the petitioner no.1 seeks permission to withdraw the pre-arrest bail petition. This bail petition of the petitioner no.1 is dismissed as withdrawn.

Heard learned counsel for the petitioner no.2 and the State.

Petitioner no.2 (Anil Ram) apprehends arrest in a case registered for the offence punishable under sections 341, 323, 325, 307, 504, 354/34 of the Indian Penal Code. As per the prosecution case, all the FIR named accused persons including petitioner no.2 assaulted the brother of the informant by means of iron rod.

Patna High Court CR. MISC. No.11814 of 2023(2) dt.28-04-2023 2/2 Learned counsel for the petitioner no.2 submits that there is general and omnibus allegation against the petitioner no.2. Doctor has found simple injury. Similarly situated coaccused Jetu Kumar @ Jitu Ram and Mohan Ram have already been allowed pre-arrest bail by a Co-ordinate Bench of this Court vide Paragraph 9 of the bail petition. Petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition of the petitioner no.2.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner no.2, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M Nalanda at Bihar Sharif in connection with Noorsarai P.S. case no 312 of 2019 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
