The Petitioner seeks bail in Fatuha P.S. Case No. 416 of 2016 instituted for the offence under Section(s) 30, 37, 38 of the Bihar Excise Amendment Act, 2016.

As per written report, the petitioner was guard of M/s Presaging Engineering Corporation. It is alleged that two bottles of Royal Stag out of which one was empty and one contained 200 ML of liquor was recovered.

It has been submitted on behalf of the petitioner that other co-accused Anil Kumar Gupta has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 11685 of 2017.

Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna City in connection with Fatuha P.S. Case No. 416 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
