2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 25(1-b) a , 26 , 35 of Arms Act.
3. As per the prosecution case, on secret information a raid was conducted at the place of occurrence where a country made pistol inserted with a magazine with one alive catridge of K. F8MM & two alive cartridge were recovered from possession of co-accused Chhotu Singh as well as a samsung mobile recovered inserted with two SIMS as 1 Idea and 2 Airtel. It is further alleged that the accused could not produce any valid paper regarding recovered weapons on demand.
4. It is submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.13144 of 2024(2) dt.12-03-2024 2/2 petitioner is not named in the FIR and his name has been transpired on the basis of confessional statement of co-accused Chhotu Singh . Nothing has been recovered from the possession of the petitioner nor he is connected with the alleged occurrence . Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Banka in connection with Amarpur P.S. case No. 614 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
