2. The petitioner apprehends his arrest for the offences alleged under Section 7 of the E.C. Act registered in connection with Tariyani P.S. Case No. 74 of 2015.
3. It is submitted that the petitioner has been falsely implicated merely on the confessional statement of Prabhu Sahni from whose possession 70 liters of kerosene oil was seized. The petitioner is PACS Chairman who has to distribute kerosene oil. No discrepancies or irregularities have been found in his stocks or display board. It is claimed that the petitioner does not know the said Prabhu Sahni and has no connection with him. No coupon holders have also made any complaint for non-supply or for supply in
Patna High Court Cr.Misc. No.8277 of 2016 (2) dt.12-04-2016 black market by the petitioner.
4. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 74 of 2015, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
