Petitioners seek bail in connection Goraul P.S. Case no. 184 of 2020 registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 354B, 324, 504 and 302 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner nos. 1 and 2 are in custody since 02.06.2020 and petitioner no. 3 is in custody since 19.07.2020 and are persons with clean antecedent and charge sheet has been submitted. No.21303 of 2021(3) dt.24-11-2021 2/3 manifest that petitioners along with eight accused persons came to the house of the informant and started abusing and when the informant objected all accused persons started assaulting and they were variously armed with lathi, danta and sharp weapon and when family members of the informant came to save him, accused Ranglal Baidh assaulted the son of the informant (Rahul) on head by lathi leading to injury and he was referred to PMCH and thereafter all accused persons tried to outrage modesty of Pavitri Devi, Bhabhi of the informant. Learned counsel for the petitioners next submits that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of assault leading to death is against Ranglal Baidh as aforesaid outrage modesty of sister-in-law of the informant is alleged, same is ornamental and not specific against these petitioners.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioners are in jail custody as aforesaid, charge sheet has been submitted and are persons with clean antecedent, the petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl.
