This is a petition for grant of regular bail for offence under Section 304B/34 of the Indian Penal Code. The petitioner is father-in-law of the victim, Shabina Khatoon. After the marriage the victim was residing with the husband in a rented house, behind the house of Dr. Mithlesh Sharma. After the death allegation is that the same was committed for non-fulfillment of demand of dowry by physical assault.

Submission of the petitioner is that in fact the victim died due to quarrel with her husband, who is already in custody and the petitioner, who is an old man, has falsely been implicated to pressurize.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand)

Patna High Court Cr.Misc. No.8584 of 2017 (3) dt.28-03-2017 2/2 with two sureties of the like amount each in connection with Gopalganj P.S. Case No. 472 of 2016 to the satisfaction of the Chief Judicial Magistrate, Gopalganj, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
