Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 927 of 2021 lodged under Sections 302, 201 and 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that wife is the informant, who filed the present case against her husband and her bhaisur (the petitioner). He further submits that information of this event has been communicated by the petitioner to the informant. Learned counsel further submits that in paragraph-9 of the petition his specific plea is that the petitioner resides separately and he has no concern with the

Leaned counsel for the petitioner further submits that petitioner is in custody since 20.11.2021 and charge sheet has already been filed. He also submits that there is one case pending against the petitioner but the said case was also filed by the same informant otherwise he has no criminal antecedent. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of the case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 927 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. with other following conditions:

A. The petitioner shall support in trial and shall appear physically before the lower court on each and every date fixed, in case of non-appearance for two consecutive dates without sufficient cause, shall resulted into cancellation of his bail bond.
