The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 302 and 120B of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, it is stated by the informant that as a result of differences between Lal Kumar Yadav and Ajit Kumar Mehta, it transpires that Ajit Kumar Mehta hired a professional killer namely Vikky Mehta on whose orders the six shooters named in the F.I.R including the petitioner herein carried out the occurrence. They were seen going towards and coming from the place of occurrence. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide
Patna High Court CR. MISC. No.14501 of 2023(2) dt.29-03-2023 2/2 order dated 17.1.2023 (Annexure-1) passed in Cr. Misc. no. 33958 of 2022 giving liberty to the petitioner to renew his prayer for bail after framing of charge. Referring to the order dated 1.11.2022 contained in Annexure-3, it is submitted that charge has been framed against the petitioner. The petitioner is in custody since 11.4.2022 and undertakes to cooperate in the trial.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, liberty granted to the petitioner in the aforesaid order of rejection dated 17.1.2023, charge having been framed in the case together with the petitioner having remained in custody for more than 11 months since 11.4.2022, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no. 192 of 2022 (arising out of Uda Kishunganj P.S. Case no.19 of 2022) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Madhepura.
