The petitioner seeks bail in connection with Rosera P.S. Case No. 04 of 2016 registered under Section 414/34 of the Indian Penal Code.
One motorcycle, alleged to be stolen, was recovered from the house of the co-accused Diwakar Das. The said Diwakar Das was apprehended by the police and on his confessional statement, this petitioner named has been surfaced. Learned counsel for the petitioner submits that except the confessional statements as well as criminal antecedent of the petitioner, there is nothing against him. He further submits that similarly situated co-accused have been allowed bail by a co-ordinate Bench of this Court vide order dated 26.07.2016 and
Patna High Court Cr.Misc. No.10093 of 2017 (2) dt.08-03-2017 2/2 19.08.2016, passed in Cr. Misc. No. 29027 of 2016 and 33904 of 2016 respectively. The case of this petitioner stands on similar footing and he deserves bail. The petitioner is in custody since 15.02.2016.
Learned APP, on the other hand, opposed the prayer. Considering the nature of the allegation against the petitioner and similarly situated co-accused enjoying the privilege of bail, his prayer of bail is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rosera in connection with Rosera P.S. Case No. 04 of 2016.
