The petitioner seeks bail in Muzaffarpur Sadar P.S. Case No. 01 of 2014 registered for the offences punishable under Sections 406, 420, 467, 468, 471, 120B and 34 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide order dated 06.02.2015 passed in Cr. Misc. No. 51956 of 2014. The prayer for bail of co-accused Suraj Kumar Singh @ Suraj Singh @ Chunnu Singh @ Niraj Kumar Singh was also rejected on the same day in Cr. Misc. No. 41523 of 2014 but, he has already been enlarged on bail vide order dated 30.01.2017 passed in Cr. Misc. No.50093 of 2016 on the ground that inspite of direction of this Court to conclude the trial, the court below could

The S.S.P., Muzaffarpur was also present in Court on 30.01.2017 and he undertook to produce all the witnesses within fifteen days from that date but, still the trial has not yet been concluded. The petitioner is in jail since 02.04.2014. The petitioner has already remained in jail for more than three years and similarly situated co-accused Suraj Kumar Singh @ Suraj Singh @ Chunnu Singh @ Niraj Kumar Singh has already been enlarged on bail.

Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-cum-Sub Judge VI, Muzaffarpur in Muzaffarpur Sadar P.S. Case No. 01 of 2014.
