The petitioner seeks regular bail in connection with Barari (Semapur) P.S. Case No. 08 of 2023 registered for the offence punishable under Sections 467, 468, 413, 414/34 of the Indian Penal Code.

As per the prosecution case, one mini truck has been recovered by the police from thatched house of the petitioner in his presence.

Learned counsel for the petitioner submits that petitioner's house is situated opposite to road and he has no knowledge about the stolen truck as alleged and the seizure list as prepared by the police is also doubtful as the same did not bear the signature of the petitioner. The petitioner is languishing

Patna High Court CR. MISC. No.11976 of 2023(2) dt.15-05-2023 2/2 in jail custody since 07.01.2023 and he has clean antecedent. Charge sheet has already been filed against the petitioner and there is no chance of any tampering the evidence by the petitioner.

Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - III, Katihar in connection with Barari (Semapur) P.S. Case No. 08 of 2023.
