JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-06-2020 The petitioner, who is in custody since 03.07.2019, seeks bail in connection with Barauni (Chakiya) P.S. Case No. 251/2019, dated 12.06.2019 [G.R. No. 2084/19], instituted for the offence under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
Three persons are said to have came to the house of the informant, variously armed with weapons and the petitioner and one Thutha Mahton are said to have fired at the informant. The informant has categorically stated that the firing resorted to by the associate of the petitioner hit him in his abdomen. The injury report also speaks of one gun shot wound.
It has been submitted that the petitioner and the
Patna High Court CR. MISC. No.9803 of 2020(3) dt.01-06-2020 2/2 informant are next door neighbours and there is a long standing enmity between them.
The petitioner was earlier made an accused in a case about which reference has been made in paragraph 3 of the bail petition and in that case, he is on bail. Considering the nature of accusation and the period of custody, petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakiya) P.S. Case No. 251/2019 [G.R. No. 2084/19]. The application stands allowed.
