JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner as well as learned APP.

At an earlier occasion, considering the submissions made on behalf of petitioner, a direction was given to the learned lower court to release the petitioner on bail to its own satisfaction, in case, he succeeds in substantiating his plea that the motorcycle belonged to his cousin brother and with the aforesaid privilege, prayer for bail was disposed of.

Learned counsel for the petitioner submits that the document relating to said motorcycle is not available. From his conduct it is apparent that the motorcycle so seized happens to be a stolen one.

Accordingly, the learned lower court is directed to proceed with the trial and will endeavour to conclude the same within a year. In case, the trial is not concluded within the

Patna High Court Cr.Misc. No.10029 of 2017 (2) dt.01-03-2017 aforesaid period, petitioner will be at liberty to renew his prayer for bail. Side by side, the learned lower court as well as Superintendent of Police, Muzaffarpur will file an explanation on account of non compliance of the Court's order. Office to communicate accordingly.
