JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Ghoshi P.S. Case No. 229 of 2016, registered under Sections 302 and 201 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, it has come that this petitioner used to teach in the coaching centre of the deceased and on the request of the petitioner, one girl was appointed in the coaching centre. Later on, due to some dispute petitioner and the girl left the coaching centre of the deceased and case was also lodged from both sides due to that reason the name

Patna High Court Cr.Misc. No.15055 of 2017 (2) dt.26-04-2017 of the petitioner has surfaced in the present case mere on suspicion. Further submission is that petitioner is accused in one another case, i.e., Kankarbagh P.S. Case No. 353 of 2016, which was lodged by the deceased. The petitioner is in custody since 08.08.2016 and the charge sheet has already been submitted against him.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Ghoshi P.S. Case No. 229 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
