JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 17-06-2020 Heard the parties through the virtual court proceeding. The petitioners apprehend their arrest in connection with Sikraul P.S. Case No.91 of 2019 registered for the offences punishable under Sections 147, 149, 341, 323, 504, 307, 337, 379, 324 of the Indian Penal Code.
The prosecution story in short is that on 10.08.2019 at 4.30 P.M., informant Ram Prawesh Bhar was sitting at his house. He saw tht named persons including petitioners were closing the way of the informant. Then he went there and asked why they are closing the way. On this point, named persons abused and assaulted him. Degree Bhar hit by Garasa upon brother of the informant and Gobardhan Bhar hit by Rami upon the head of the informant. Thereafter, they fled away. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.9534 of 2020(2) dt.17-06-2020 2/2 petitioners are innocent and have committed no offence. The allegation as have been alleged in this case is quite false and fabricated. Learned counsel for the petitioners further submits that the informant and petitioners are Gotiyas/co-villagers. Both have civil dispute and all the injuries caused by hard and blunt is simple in naute, which is clear from the impugned order. There is general and omnibus allegation against the petitioners. Learned A.P.P. for the State has opposed the prayer for bail of the petitioners.
In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each only with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Sikraul P.S. Case No. 91 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
