JUSTICE SANJAY PRIYA ORAL ORDER 27-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Alauli P.S. Case No. 287 of 2015 instituted for the offence under Sections 395, 397 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted that petitioner is not named in the written report. His name has come on mere suspicion. From the order of the learned Sessions Judge it appears that besides confessional statement, there is no material against the petitioner at that stage. Petitioner is said to be in custody since 25.2.2017.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.19007 of 2017 (2) dt.27-04-2017 2/2 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Alauli P.S. Case No. 287 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
