The petitioner is accused in connection with Pupri P.S. Case No. 149 of 2015 registered under sections 302 of the I.P.C. pending in the Court of S.D.J.M, Pupri, Sitamarhi. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case. Further submission is that there is no cogent material in the case diary to corroborate the allegation that the petitioner had administered the poison to the deceased.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is specific allegation against the petitioner and others to administer
Patna High Court Cr.Misc. No.16266 of 2017 (3) dt.20-06-2017 2/2 the poison to the deceased and in the case diary, the witnesses also support the allegation as alleged in the F.I.R. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
