The petitioner seeks bail in connection with Singheshwar P.S. Case No.37 of 2003 registered under Sections 302/34 of the Indian Penal Code.

The accusation of the informant Virendra Yadav is that on 04.08.203 in the evening at about 04.00 P.M., his brother Surendra Yadav went outside the house on a bicycle but he did not return. On 06.08.2003 in the morning at about 08.00 A.M., Dukho Yadav, the covillager of the informant, informed him about throwing of dead body of his brother in a canal. Thereafter, the informant went there and found the dead body of his brother there sustaining sharp cutting injuries on different parts of his dead body. Five days earlier, one Arvind Yadav

Patna High Court Cr.Misc. No.21012 of 2017 (3) dt.28-07-2017 2/2 had come to the house of the informant and made query from him about the whereabouts of his brother saying that theft has been committed in his house by his brother. The informant raised suspicion against Arvind Yadav and this petitioner having hands in committing the murder of his brother Surendra Yadav.

Learned counsel appearing on behalf of the petitioner submits that only suspicion has been raised by the informant against the petitioner having hand in the murder of his brother Surendra Yadav. Except suspicion, during investigation, no material has been collected by the Investigating Officer against the petitioner. The petitioner having no criminal antecedent is in custody since 20.03.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura, in connection with Singheshwar P.S. Case No.37 of 2003.
