The petitioner seeks bail in Singheshwar P.S. Case No. 118/2016, registered for the offences punishable under Section 392 of the Indian Penal Code.

The informant lodged the case against unknown for robbery of his motorcycle bearing registration no. BR-43E-3748. Money and mobiles etc. were also robbed.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R.. Name of the petitioner figured in the confessional statement of one Kanhaiya Kumar Yadav. The confession led to the recovery of the motorcycle from a bamboo bush by the side of T.P. College Madhepura. On search

Patna High Court Cr.Misc. No.20482 of 2017 (2) dt.05-05-2017 the petitioner was arrested on 20.10.2016. The petitioner is in jail for more than 06 months, but he has not been put on Test Identification Parade. Save and except confession of the coaccused there is no tangible material against the petitioner. Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No. 118/2016.
