Petitioner seeks bail in a case registered for the offence punishable under Sections 272, 273, 290/34 of the Indian Penal Code, Section 25(1-b)A, 26 and 35 of the Arms Act and Sections 30(a) and 37(b)(c) of the Bihar Prohibition & Excise Act, 2016.

Informant who is a Police Officer has alleged that he received a confidential information that some persons are taking liquor and on receipt of said information, police party raided the place and found four persons taking liquor and on seeing the police, two managed to escape whereas two accused were arrested and from possession of petitioner, one country made pistol with one loaded cartridge were recovered. From the place of occurrence 375 ml. liquor was also recovered.

Patna High Court CR. MISC. No.11244 of 2019(2) dt.04-04-2019 2/3 It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 08.11.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Khajauli P.S. Case No.198 of 2018 / G.R. No.1770 of 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.

(4) If the petitioner is found involved in similar nature of offences, after his release on bail
