The petitioner is languishing in custody for the offences punishable under Sections 498A/304B/34 of the Indian Penal Code.

Wife of this petitioner died after six years of marriage by hanging herself with the ceiling. Allegation is that death was due to non-fulfillment of dowry demand and torture; whereas submission of learned counsel for the petitioner is that the witnesses have stated before the police that the deceased had extramarital relation with one Vicky Singh and the husband had seen Vicky Singh coming out of the room of the deceased and for that reason

Patna High Court CR. MISC. No.12422 of 2019(4) dt.08-05-2019 2/2 both husband and wife had quarrel and the deceased committed suicide. The petitioner is in custody since 29.05.2018.

Considering the entire facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bihar P.S. Case No.425 of 2013, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
