JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2016 Heard learned counsels for the petitioner and the State. The matter has been placed in view of the administrative order of Hon'ble the Acting Chief Justice dated 4.4.2016 at Flag - A since the co-ordinate bench which has earlier rejected the prayer for bail of the petitioner vide Cr. Misc. No. 9555 of 2015 is not available due to medical exigencies.

The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

The accusation is of abducting the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.4911 of 2016 (2) dt.07-04-2016 2/2 earlier prayer of the petitioner was rejected with liberty to renew his prayer if the victim is recovered and makes her statement against the petitioner. It is further submitted that while recording the statement of the victim under section 164 Cr.P.C. the learned court below assessed her age as 18 years where she stated that she of her own married with co accused Raj alias Amit who has been granted anticipatory bail by the learned Sessions Judge vide ABP No. 2480 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 11th Additional Sessions Judge, Muzaffarpur in connection with Ahiyapur P.S. Case No. 451 of 2014..
