JUSTICE SHIVAJI PANDEY ORAL ORDER 10-09-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking regular bail in connection with S.Tr. No. 239 of 2016 arising out of Goreakothi P.S. Case No. 177 of 2015 registered for offence punishable under sections 302, 307 and 324 of the Indian Penal Code. Already the petitioner had moved before this Court on two occasions unsuccessfully. The petitioner has again come for grant of bail in the aforesaid case.
This Court has called for the status report of the case. It has been informed by the Incharge Additional District and Sessions Judge-I- cum- Special Judge, Siwan, vide letter dated 14.07.2020 that all the charge-sheeted witnesses were examined and the statement of accused was recorded and
Patna High Court CR. MISC. No.13971 of 2020(3) dt.10-09-2020 2/2 whereafter, the petitioner has filed an application for examination of only one defence witness. In the mean time, the Central Government has imposed Lock Down, on that account, the court below could not run in a proper manner. This Court directs that the Presiding Officer, after restoration of normalcy, the defence witness should be examined by the petitioner and the case should be put on argument and disposed of the same within a period of six months on the restoration of normalcy.
With the above observation and direction, this bail application is rejected.
