====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in case registered for the offences punishable under Sections 394, 307 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that one Balwant Sardar along with three other accused persons assaulted the informant on point of pistol and snatched away his motorcycle and some cash. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Petitioner is not named in the F.I.R. and his name transpired during course of investigation. No stolen article has been recovered from the possession of the petitioner. Learned counsel for the State opposes the bail

Patna High Court CR. MISC. No.11107 of 2023(2) dt.16-05-2023 2/2 application and submits that name of the petitioner transpired during course of investigation and he has got 9 criminal antecedents and some of them are of similar nature. Considering the nature of accusation and criminal antecedents, prayer for anticipatory bail of the petitioner is refused.
