JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Bhagwanpur P.S. Case No. 137 of 2015, disclosing offence under Sections 323 and 392 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner has very fairly submitted that similarly circumstanced co-accused Mokhtar Rai alias Mukhtar Rai had approached this Court for grant of anticipatory bail by Criminal Miscellaneous No. 2975 of 2016 which came to be disposed of by an order dated 19.01.2016 and the present application may also be disposed of in terms of the said order.

Patna High Court Cr.Misc. No.5894 of 2016 (2) dt.22-02-2016 2/2 Considering the fair submission made on behalf of the petitioner, this application is disposed of with a direction that let the petitioner appear before the court below within a period of six weeks from today and seeks regular bail, if so advised. If he does so, his application for regular bail shall be considered in the light of this Court's order, dated 19.01.2016, passed in Criminal Miscellaneous No. 2975 of 2016.

This application stands disposed of with the observation as aforesaid.
