The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner assaulted the informant's father by means of lathi and danda on his head, due to which his father became seriously injured and fell down. He was taken to the Hospital, where the doctor declared him dead.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.05.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated

Patna High Court CR. MISC. No.11825 of 2019(3) dt.09-05-2019 2/2 in the present case. The petitioner along with other co-accused are said to have assaulted the deceased with hard and blunt substance. There is only one external injury on the body of the deceased. General and omnibus allegation has been made. No specific injury has been attributed against the petitioner. Coaccused has been granted bail vide Cr.Misc.No.68414 of 2018. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge VII, Rohtas, Sasaram in connection with Sessions Trial No.385 of 2018 arising out of Kochas P.S. case No.91 of 2018.
