The petitioner seeks bail in Itarhi P.S. Case No. 148/2016, registered for the offences punishable under Sections 457, 380 and 414 of the Indian Penal Code.

Theft was committed in the house of the informant and for that the informant lodged the case naming the petitioner and others and alleged that the petitioner and others were roaming around the house of the informant.

Learned counsel for the petitioner submits that the house of the petitioner was searched and one Briefcase was recovered along with voter I.D., but no stolen article was recovered from the house of the petitioner. The petitioner is said to have confessed his guilt before the police. It is submitted that the police forcibly

Patna High Court Cr.Misc. No.11158 of 2017 (2) dt.10-03-2017 got the confessional statement of the petitioner. The petitioner is in jail since 30.11.2016. The petitioner has already remained in jail for more than three months.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Itarhi P.S.
