2. The petitioner apprehends his arrest in connection with Hemjapur P.S. Case No. 73 of 2025 dated 12.10.2025 registered for the offences punishable under Sections 111(4) of the of the B.N.S. and Sections 25(1)(a), 25(1A), 25(1AA), 25(1B)(a), 25(1B)(c), 26(1), 26(2) and 35 of the Arms Act.

3. The prosecution case is to the effect that the police conducted a raid and apprehended certain persons with country made pistol and the apprehended persons disclosed that they along with the petitioner and others used to manufacture and carry out sale of the country made pistol.

4. The learned counsel for the petitioner submits that the petitioner was not apprehended and no incriminating article has been recovered from his possession. It has further been submitted that the petitioner is a daily wage labourer and he has falsely been implicated. It has further been submitted that it is only on the confessional statement of the persons who were apprehended that the name of the petitioner has transpired. It has lastly been submitted that the petitioner has two criminal antecedents of similar nature.

The learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner and has stated that the petitioner is involved in manufacturing of country made pistol and in the search, huge quantity of country made pistol with magazine etc., were recovered and the petitioner is stated to be one of the associates of the apprehended accused persons and the criminal antecedent itself speak about the petitioner.

Considering the aforesaid and taking into account the criminal antecedent of the petitioner which is of similar nature, the prayer for anticipatory bail of the petitioner is hereby dismissed and the petitioner is directed to surrender before the Court below concerned within four weeks from the date of this order and pray for regular bail, the learned Court below may consider the prayer

Patna High Court CR. MISC. No.11756 of 2026(2) dt.25-02-2026 3/3 for regular bail of the petitioner on its own merits without being prejudiced by this order.
