This is an application for grant of regular bail filed on behalf of the petitioners. Petitioners are in custody in connection with Bishambharpur PS Case No. 03 of 2019 for the alleged offence punishable under Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

It is alleged that 40 liters of country made liquor was recovered from the gallon kept on the seat of a motor cycle. Learned counsel representing the petitioners submits that petitioners have no criminal antecedent and recovery was not made either from the possession or from the house of the petitioners. They are in custody since 14.01.2019.

No.10191 of 2019(2) dt.20-02-2019 2/2 Considering the fact that petitioners have no criminal antecedent and the period of incarceration undergone by them, this application is allowed. Accordingly, let the petitioners above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IIcum-Special Judge, Excise, Gopalganj in connection with Bishambharpur PS Case No. 03 of 2019.
