====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-04-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

As per prosecution case, informant suspects that F.I.R. named accused persons committed murder of the brother of the informant.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and is not named in the F.I.R. Name of the petitioner transpired during course of investigation and only material that has come against him is that he was found talking to the deceased on mobile phone on the date of occurrence.

No.10798 of 2023(2) dt.27-04-2023 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P. S. Case No. 214 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
