JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/375/366/504/506/34 of the Indian Penal Code and 25 (1-B)a of the Arms Act.
Accusation is of abducting the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that the victim with her own went in the company of the petitioner and subsequently performed marriage with him and now they have an issue also. Though, the case was registered in 2012 but the police never apprehended the petitioner. Moreover, the victim girl has also sworn an affidavit to the effect that she of her own went in the company of the petitioner.
Patna High Court Cr.Misc. No.4338 of 2016 (2) dt.01-02-2016 2/2 Under the circumstances, let the petitioner produce the victim girl before the learned court below on 1st of March, 2016 when the learned court below will record her statement wherein if she admits her marriage with the petitioner with her own sweet will, then the learned court below will pass appropriate orders and release the petitioner on bail. In case, the victim girl in her statement to be recorded before the learned court below admits otherwise, then the petitioner will surrender and pray for regular bail.
Meanwhile, let no coercive step be taken against the petitioners in connection with Karpi P.S. Case No.83/2012, pending before the learned CJM, Jehanabad.
With the above observation, this application is, accordingly, disposed off.
