JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 14-09-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehends their arrest in connection with Nauhatta P.S. Case No. 63 of 2021, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 504, 506 of the Indian Penal Code.

As per allegation, eight FIR named accused persons including the petitioners badly assaulted the mother of the informant and when the informant and his family members went to rescue her, co-accused Nijamuddin @ Badri assaulted the informant on his head

Patna High Court CR. MISC. No.11606 of 2022(2) dt.14-09-2022 2/2 by lathi and co-accused Shabana inflicted spear blow on the leg of the mother of the informant and she became injured. The mother of the informant was shifted to primary health center where she was declared dead.

Learned counsel for the petitioner has submitted that the petitioners are ladies and they have been arrayed as accused with the male members of the family. He has also submitted that the allegations against them are general and omnibus. The accused persons badly assaulted the mother of the informant and made her injured. She succumbed to the injuries suffered by her. In my view, the petitioners are not entitled for anticipatory bail. Accordingly, it is rejected. If the petitioners surrender before the court below and make a prayer for regular bail, that shall be disposed of without being prejudiced by this order.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- kundan U T
