2. With the consent of the parties, the present writ petition is being disposed of at the stage of Admission itself.

3. Learned counsel appearing on behalf of the petitioner informs that tomorrow, i.e. 10.02.2024, is the date fixed for the Special Meeting of No Confidence Motion, however, he submits that the voting must be conducted among the elected members, who will be present tomorrow during the time of special meeting of "No Confidence Motion".

Considering the aforesaid submission made on behalf of the petitioner, the Deputy Development Commissioner-cumChief Executive Officer, Zila Parishad, District, Patna must not interfere in any manner, while the special meeting is being held and Presiding Officer nominated by the House must ensure fair play and follow the democratic process in declaration of the result in accordance with the provision of Section 63(2) of the Bihar Panchayat Raj Act, 2006.

5. The writ petition stands disposed of.
