The petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 168 of 2016 registered under Sections 447, 341, 323, 308, 354, 379, 504 and 34 of the I.P.C. and 3⁄4 of the Dian Act pending in the Court of A.C.J.M.-III, Vaishali at Hajipur.
Learned counsel for the petitioner submits that petitioner is innocent and has falsely been dragged in this case due to village politics. It is also submitted that petitioner and informant are the agnates.
Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission that there is specific allegation of assault by means of Hasuli
Patna High Court Cr.Misc. No.9868 of 2017 (3) dt.18-04-2017 2/2 against the petitioner.
Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, the application is rejected.
