2. Earlier, the prayer for bail of the petitioner was rejected vide order dated 06.09.2023 passed in Cr. Misc. No. 40557 of 2023.

3. The petitioner seeks bail in connection with Baligaon P.S. Case No. 38 of 2015 registered for the offence under Sections 147, 148, 149, 435, 427, 387, 506 of the Indian Penal Code and under Section 27 of the Arms Act and also section 17 of the C.L.A. Act.

4. On 21.02.2025, the petitioner was granted provisional bail for his treatment and marriage of his daughter as he was under going treatment in IGIC, Patna.

5. Learned counsel for the petitioner has submitted that the petitioner is a heart patient and is still under treatment

Patna High Court CR. MISC. No.10703 of 2025(4) dt.11-07-2025 2/2 by the doctors in IGIC and is unable to walk. The petitioner is 70 years old. The allegation is of burning a tractor.

6. Learned counsel for the State has opposed the prayer for bail.

7. Considering the aforesaid fact, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 11th, Vaishali at Hajipur/concerned Court below in connection with Baligaon P.S. Case No. 38 of 2015, with a condition that he will cooperate in the trial either by personally or through by his lawyer.
