The petitioner is accused in connection with Rosera P.S. Case No. 221 of 2016 registered under Sections 379 and 411 of the Indian Penal Code.
Learned counsel for the petitioner submits that he has been falsely implicated in the present case only on the confessional statement of a co-accused. There was no recovery from the conscious possession of the petitioner. He is in custody since 18.10.2016. Also similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 130 of 2017 by order dated 12.01.2017.
Be that as it may, considering the facts and
Patna High Court Cr.Misc. No.5308 of 2017 (2) dt.09-03-2017 2/2 circumstances of the case and from materials available on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rosera, in connection with Rosera P.S. Case No. 221 of 2016.
