The petitioners seek regular bail in connection with Kotwali P.S.Case No.360 of 2019 registered for offences punishable under Sections 147, 148, 149, 323, 307, 379, 427, 448, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, 20-25 persons came at the shop of the informant, damaged the counter and also took away Rs.30,000/- . Petitioner is not named in the FIR and later on his name transpired on the confession.
Submission of the learned counsel for the petitioners is that except the confession, there is nothing against him. So far
Patna High Court CR. MISC. No.9017 of 2020(2) dt.03-03-2020 2/2 this peitioner is concerned, he is in custody since 25.9.2019. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Kotwali P.S.case No.360 of 2019. With the above direction, this application is allowed.
