====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-05-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 18.08.2018 in a case for the offence registered under Sections 457 and 380 of the IPC. Subsequently, Sections 411 and 414 of the IPC were also added.

The prosecution story, in brief, is that onj 15.08.2018, the informant's Motorcycle bearing Registration No. BR-37N6726 was stolen by unknown thieves from Ward No. 1, Paschimpali Kishanganj.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present

Patna High Court CR. MISC. No.12791 of 2019(2) dt.02-05-2019 2/2 case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The petitioner had no knowledge regarding the stolen Motorcycle in question. He had purchased the said Motorcycle in question without having knowledge that the same is stolen property.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Kishanganj, in connection with Kishanganj P.S. Case No. 525 of 2018.
