JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 419/420 of the Indian Penal Code.

Allegation against the petitioner is of cheating to the named person on the pretext of getting smart card created in favour of different persons including the informant. Considering the general and omnibus allegation, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Hilsa, Nalanda/Successor Court, in

Patna High Court Cr.Misc. No.19410 of 2017 (2) dt.25-04-2017 2/2 connection with Islampur P.S. Case No.68 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.

Before accepting the bail bond the learned Court-below shall verify about the criminal antecedent of the petitioner and if the petitioner would have criminal antecedent, bail bond shall not be accepted and matter would be reported to this Court.
